Terms & Conditions

  1. Go Kiwi Internet conducts all business IN WRITING - no exceptions.

    FINANCIAL
  2. All prices quoted are $NZD including GST
  3. Prices are valid for a period of 30 days from the date of quotation.
  4. Go Kiwi Internet only commences work upon receipt of written confirmation to proceed and the agreed deposit (e-mail, paper or fax).
  5. Go Kiwi Internet does not give refunds.
  6. Interest will accrue on overdue accounts from the due date until paid at a rate of 2.5% per month, and collection costs are payable if incurred in collecting overdue monies.

    DEVELOPMENT MATTERS
  7. E-Mail from Go Kiwi Internet managed Domain Name can be forwarded to any POP account or free e-mail service (i.e. GMail, Hotmail or Yahoo).
  8. Domain Names are registered and managed by Go Kiwi Internet as Agent for you (the client).
  9. Domain Names registered by us on your behalf are subject to availability at the time that an order is confirmed with us.
  10. Unless specifically guaranteed in writing to be completed by a specific deadline, website publication dates are ESTIMATED dates only.
  11. Unless logo suppression is installed, Go Kiwi Internet websites include a single, web developer back-link on the bottom of every web page.
  12. You may use any ISP to connect to the Internet, and change your ISP as you wish with no affect on your website.
  13. Go Kiwi Internet does not provide Internet access, nor support for Internet dial-up, Broadband nor Internet access problems.
  14. Except for the initial training, all technical support relating to updating your website or Kwik-Az Updating is available via e-mail (at no charge) or by phone (charged on an hourly basis).

    "UNDESIRABLES"
  15. All services provided by Go Kiwi Internet may be used for lawful purposes only.
  16. Pornography and sex-related merchandising are prohibited on any Go Kiwi Internet website or server.
  17. Objectionable material is prohibited on any Go Kiwi Internet website. This includes, but is not limited to: copyrighted material or material protected by trademark and material judged to be abusive, threatening, malicious, slanderous or obscene. Go Kiwi Internet will be the sole arbiter as to what constitutes a violation of acceptable material and content.
  18. Spamming, or the sending of unsolicited email, from a Go Kiwi Internet server or an email address that is maintained on a Go Kiwi Internet server is prohibited. Go Kiwi Internet will be the sole arbiter as to what constitutes a violation of this provision.

    19. CANCELLATION
  19. A client may cancel any service provided by Go Kiwi Internet at any time WITHOUT PENALTY, except when a website is financed in which case approval is required from the Finance Company in writing prior to cancellation.
  20. Websites developed by Go Kiwi Internet can be transferred to any other Hosting Service Provider AT ANY TIME WITHOUT PENALTY, although it should be remembered that the Kwik-Az Updating facility is only available to websites hosted by Go Kiwi Internet.
  21. Go Kiwi Internet may cancel or suspend any service provided, in the event of delinquent accounts, or upon the expiry of any pre-paid term or upon any other breach of these terms and conditions. In the event of any service suspension, reinstatement charges will apply.
  22. Upon cancellation of any service provided to the Customer and after all monies due to Go Kiwi Internet and the Finance Company have been paid, Go Kiwi Internet agrees to fully co-operate with and facilitate the transfer of any services to the Customer or to the Customer's nominee.

    23. INDEMNITIES, RESPONSIBILITIES & COPYRIGHT
  23. In this quotation Go Kiwi Internet refers to Go Kiwi Internet Ltd (A New Zealand registered company; No. AK 2374245)
  24. All Go Kiwi Internet clients own their own website and we place your copyright details on all pages. This copyright includes all logos, artwork and graphics created by Go Kiwi Internet on behalf of the client.
  25. All images and files used on the website (including web graphics, video and sound files- *.JPG, *.GIF, *.SWF, *.AVI, *.MP3 etc), and HTML code (the website structure, layout and formatting) are owned by the customer.
  26. All master files developed by Go Kiwi Internet and used in the creation of logos, artwork, animations and graphics on behalf of the client (e.g. *.MIX, *.CDR, *.FLA, *.PSD etc remain the property of Go Kiwi Internet at all times unless specifically purchased from Go Kiwi Internet separately from the purchase of a website.
  27. Kwik-Az Updating features and functionality remain the property of Go Kiwi Internet and are only available to websites while hosted with Go Kiwi Internet.
  28. The customer agrees that Go Kiwi Internet may delete all data, files or other information that is stored on the customer's behalf, if either the customer or Go Kiwi Internet terminates the customer's account.
  29. While every care is taken with the security of client website data, and regular backups are undertaken on behalf of clients, the final responsibility for the retaining of up-to-date data backups remains entirely with the client. In the event of a full website restoration or recovery process undertaken by Go Kiwi Internet, data input via Kwik-Az Updating may be required to be completed by the client and reinstatement charges will apply, charged on a time-taken basis.
  30. The customer agrees to indemnify Go Kiwi Internet from all or any claims in which consequential damage may have occurred to a third party as a result of the customer's use of Go Kiwi Internet services.
  31. The customer indemnifies Go Kiwi Internet for any breach of intellectual property, trade mark, copyright or other liability incurred in obtaining or managing requested Domain name(s).
  32. The Customer hereby authorises Go Kiwi Internet to act as agent for and to register and administer on the Customer's behalf for the period of agreement, all Domain Names requested by the Customer with the appropriate authority.
  33. The customer accepts that the use of a Domain Name, is subject to the Terms & Conditions of the appropriate TLD Registry & Registrars, and by using a domain name agrees to the appropriate Terms & Conditions of the TLD Registry:
    New Zealand Domain Names are overseen by The Domain Name Commissioner - www.dnc.org.nz
    United Kingdom Domain Names are overseen by Nominet - www.nominet.org.uk
    Australian Domain Names are overseen by au Domain Administration - www.auda.org.au
    International Names Domain Names are overseen by ICANN - http://www.icann.org

    34. FINANCING
  34. Offers of finance are subject to credit approval by the Finance Company (usually confirmed within 24 hours).
  35. If finance facilities are requested, the customer hereby authorises any person or company to provide Go Kiwi Internet or the Finance Company with such information as is required in response to enquiries associated with this business.
  36. Finance agreements require a personal guarantee from a director of the company if the customer is a private limited liability company.

    37. MARKETING
  37. Go Kiwi Internet submits websites, on request, to the primary Search Engines, but does not submit to Internet Directories that require manual listing decisions.
  38. The customer is able to optimise their website with Kwik-Az Updating including standard Keywords & Descriptions. Search Engine Optimisation and Search Engine Marketing services are an optional extra.
  39. In our experience there is a strong common misconception that the Internet is a sales tool that will automatically create business, just because it exists. This is often an unrealistic expectation as a website is simply an effective communications tool. Go Kiwi Internet makes no promises of the performance of a particular website in creating new business.
